Sleepy Valley Terms and Conditions for the Sale of Beds and Mattresses
These terms and conditions govern the sale of beds, mattresses, and related products by Sleepy Valley ("the Company") to you ("the Customer"). By placing an order with us, you agree to these terms and conditions.
1. Definitions
1.1 "Product" refers to the bed, mattress, or any related items purchased by the Customer.
1.2 "Order" refers to the purchase request made by the Customer.
1.3 "Delivery" refers to the transportation of the Product to the address specified by the Customer.
2. Orders
2.1 All Orders are subject to acceptance by the Company.
2.2 A minimum deposit of 20% of the Order value is required to confirm the purchase.
2.3 All deposits are non-refundable.
2.4 Orders cancelled after 24 hours of placement will incur a cancellation fee of 20% of the total Order value.
3. Pricing and Payment
3.1 All prices are listed in GBP (£) and include VAT unless stated otherwise.
3.2 Payment for the Order must be completed no later than 5:00 PM on the day before delivery. Failure to meet this deadline may result in the cancellation or delay of the delivery.
3.3 Customers using finance options must ensure that the person named on the finance agreement is present at the delivery address to sign for the delivery.
3.4 The Company reserves the right to adjust prices due to errors or changes in pricing from suppliers.
4. Delivery
4.1 Delivery Schedule:

Delivery can be narrowed down to a particular day; however, it is not possible to provide a specific delivery time.

A courtesy call can be made 30 minutes prior to the delivery team’s arrival to advise of their imminent arrival.

The Company does not deliver on weekends.
4.2 Delivery Times Quoted:

Delivery times quoted at the time of sale are approximate and may be subject to delays.

Delayed deliveries do not entitle the Customer to cancel the Order or claim compensation.
4.3 Delivery Address:

It is the Customer's responsibility to ensure that the delivery address provided is accurate and accessible.
4.4 Delivery Charges:
-
Delivery charges will be specified at the time of purchase and may vary based on location and delivery requirements.
4.5 Access and Safety:
-
Customers must ensure that the delivery route is free from obstacles such as furniture, wall hangings, and ornaments.

Children and pets must be secured away from the delivery area to prevent injury.

The Company is not liable for damage to property during delivery, although every reasonable care is taken to avoid accidents.
4.6 Missed Deliveries:

If a delivery cannot be completed due to the Customer’s absence or inaccessible premises, a redelivery charge may apply.
4.7 Inspection on Delivery:

The Customer must inspect the Product upon delivery. Any damages or defects must be reported to the delivery team or the Company within 24 hours.
4.8 Risk and Title:
-
Risk in the Product passes to the Customer upon delivery. Title to the Product remains with the Company until full payment is received.
4.9 Access and Delivery Route
-
Customers must ensure that the access route to the delivery address is clear and that all items will fit through access routes, including but not limited to stairs, doorways, and narrow hallways. The Company cannot be held liable for any issues that arise if the items do not fit or if there are obstacles along the access route.

If you are unsure whether the items will fit, please request our free measuring service before confirming your order. The Company will not be responsible for any difficulties in delivering or installing the product if the access route has not been properly assessed.
5. Returns and Exchanges
5.1 Non-Returnable Items:

Beds and mattresses cannot be returned due to a change of mind after delivery.
-
The Company does not offer a sleep trial or any kind of return agreement for beds or mattresses.
5.2 Offgassing:
-
New mattresses can emit a smell referred to as offgassing. This is caused by the chemicals used to produce the foam and to make the mattress fire retardant.
-
Offgassing is normal and, while some customers may find the smell unpleasant, it is not harmful and will disperse over time.

To minimize offgassing, it is recommended to leave a new mattress to air uncovered in a well-ventilated room with a window open.

The Company cannot provide replacements or exchanges due to offgassing.
5.3 Returns are only accepted in accordance with the Company’s Returns Policy for defective or damaged items.
5.4 Custom or bespoke Products are non-returnable unless faulty.
6. Mattress Settlement and Care
6.1 Mattress Settlement:
-
Mattress settlement is a normal process that occurs with luxury fillings. Over time, the fillings in a new mattress will compress slightly, creating body impressions in the sleeping area.
-
These impressions are a sign that the mattress is conforming to your body and do not constitute a fault or defect.
6.2 Flipping and Rotating:
-
To ensure even wear, new mattresses should be flipped or rotated every two weeks for the first six months.
-
After six months, mattresses should be flipped or rotated every month.
-
Following this care routine helps prolong the lifespan of your mattress and ensures even settlement.
7. Drawer and Ottoman Use
7.1 Drawer Usage:
-
The drawers on beds are designed for storing light bedding only.
-
Overfilling or storing heavy items in the drawers can cause the drawers to bow or break.
-
The Company is not liable for damage to drawers caused by overloading.
7.2 Ottoman Base Care:
-
Side-opening ottoman beds require blocks to be inserted between the bed and the headboard to avoid the mattress rubbing on the headboard.
-
If you request that these blocks not be added, the Company cannot be held liable for excessive fabric wear or damage to the headboard caused by the mattress rubbing.

Ottomans, including electric ottomans, will not close without the weight of a mattress in place.
8. Ex-Display and Clearance Sales
8.1 Ex-Display and Clearance Beds:

Ex-display and clearance beds are sold as seen and are not subject to the same warranties or guarantees as new products.

These products are sold in their existing condition, and no additional warranty or guarantee is provided.
9. Display Beds
9.1 Display beds are provided to customers for the purpose of trying before purchase.
9.2 While the Company can offer advice and guidance regarding the selection of beds, the final decision lies with the Customer.
9.3 No responsibility can be taken by the Company for an incorrect selection made by the Customer.
10. Warranty
10.1 All Products are covered by a 1 year manufacturer’s guarantee against manufacturing faults. Some items have an extended warranty or guarantee on top of this please ask staff for details specific to your purchase.
10.2 The warranty does not cover:

Normal mattress settlement or body impressions.

Wear and tear, misuse, or damage caused by improper assembly or care.
11. Liability
11.1 The Company is not liable for:
-
Delays or failure to deliver due to circumstances beyond its control.
-
Indirect or consequential losses arising from the purchase or use of the Product.
-
Damage to property during delivery, although reasonable care will be taken.
11.2 The Company’s maximum liability for any claim shall not exceed the price of the Product.
12. General
12.1 These terms and conditions are governed by the laws of Scotland.
12.2 Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Scotland.
